These Terms & Conditions (“Terms”) govern (A) your use of the Tigo Builders website (the “Site”) and (B) the provision of our construction, remodeling, design, additions, outdoor living, kitchen, and property management services (the “Services”). By using the Site or engaging our Services, you agree to these Terms.

A) Website Terms of Use

1) Eligibility & Acceptable Use

You agree to use the Site only for lawful purposes and not to harm, disrupt, or misuse the Site or others’ use of it. You will not attempt to reverse engineer, scrape, or overload the Site.

2) Information on the Site (No Professional Advice)

Content on the Site is for general information only and may change without notice. It does not constitute professional, financial, legal, engineering, or architectural advice.

3) Intellectual Property

All content on the Site—including text, designs, logos, images, and code—is owned by or licensed to Tigo Builders and protected by intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works without prior written consent.

4) Links & Third-Party Services

The Site may link to third-party websites or embed third-party services (e.g., maps, fonts, videos, social media). We are not responsible for their content, policies, or practices.

5) Privacy

Your use of the Site is also governed by our Privacy Policy. By using the Site, you consent to our data practices described there.

6) Disclaimers (Site)

The Site is provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee error-free, secure, or uninterrupted operation.

7) Limitation of Liability (Site)

To the maximum extent permitted by law, Tigo Builders will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from or related to your use of the Site.


B) Service Terms (Projects & Work Performed)

Note: These general terms apply unless otherwise stated in your signed proposal/contract. If there is a conflict, the signed proposal/contract and any change orders will control.

1) Estimates, Proposals & Scope

  • Estimates/Proposals: Our written estimate or proposal outlines scope, specifications, allowances, exclusions, and pricing assumptions.

  • Acceptance: A project is accepted when you sign our proposal/contract and provide any required deposit.

  • Exclusions: Work not explicitly listed is excluded.

2) Permits, Inspections & Approvals

We will obtain required permits and coordinate inspections unless your proposal states otherwise. HOA/ARC approvals are your responsibility unless expressly included.

3) Selections & Allowances

  • Selections: You’ll choose materials/finishes per the schedule we provide.

  • Allowances: If actual costs exceed allowances due to your selections or market changes, the difference will be added via change order.

4) Change Orders

Changes to scope, selections, or schedule must be approved in writing (email/e-signature acceptable) before work proceeds. Change orders may affect price and timeline.

5) Schedule & Access

We will provide a projected schedule and keep you updated. You will provide reasonable access to the site during stated work hours and keep areas clear of personal items that could impede progress.

6) Site Conditions & Unforeseen Conditions

If we discover hidden or unforeseen conditions (e.g., structural issues, rot, code deficiencies, hazardous materials), we will notify you and propose corrective work and cost/time adjustments via change order.

7) Payments & Billing

  • Deposit: A deposit may be required to schedule work and order materials.

  • Progress Payments: Milestone-based or periodic draws (e.g., framing, rough-ins, finishes).

  • Final Payment: Due upon substantial completion, subject to punch list.

  • Late Payments: May incur reasonable finance charges and/or work suspension until resolved.

8) Warranties & Punch List

  • Workmanship Warranty: We warrant our workmanship for [12 months] from substantial completion unless otherwise stated. Manufacturer warranties apply to materials.

  • Punch List: We will address reasonable punch-list items identified in the final walkthrough. Normal wear, misuse, or lack of maintenance are excluded.

9) Client Responsibilities

You agree to:

  • Provide accurate information, timely selections, and approvals.

  • Maintain utilities (power/water) and safe site access.

  • Keep children/pets out of active work areas and comply with safety guidance.

  • Obtain and maintain required property insurance.

10) Materials Availability & Substitutions

If specified items are unavailable or significantly delayed, we will propose equal or better substitutes for your approval, which may affect pricing and schedule.

11) Photography & Portfolio

You grant Tigo Builders the right to photograph the project (excluding personally identifying information) for documentation and marketing, unless you opt out in writing before project completion.

12) Property Management (If Applicable)

Property management services are defined in a separate agreement outlining scope, reporting, vendor coordination, fees, and emergency protocols.

13) Safety, Cleanup & Protection

We maintain a tidy jobsite, set reasonable dust controls, and protect areas per the scope. Daily cleanup occurs during active work; a final cleanup occurs at substantial completion.

14) Force Majeure

We are not liable for delays/failures caused by events beyond our reasonable control (e.g., extreme weather, labor/transport disruptions, supply shortages, pandemics, acts of government).

15) Termination

Either party may terminate for material breach if not cured within 10 business days after written notice. You remain responsible for work completed, materials ordered, and demobilization costs through the termination date.

16) Indemnification (Services)

To the extent permitted by law, each party will indemnify and hold harmless the other from claims arising out of that party’s negligence or willful misconduct in connection with the project.

17) Disclaimers & Limitation of Liability (Services)

Except as expressly stated in writing, we disclaim all other warranties. To the maximum extent permitted by law, Tigo Builders’ total liability for any claim related to the Services is limited to the amounts you actually paid to Tigo Builders for the affected portion of the project.


Dispute Resolution & Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Venue and jurisdiction will lie in the state or federal courts located in Barnstable County, Massachusetts.
If your project is located in a different state, the governing law and venue may be updated in your project contract.


Updates to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the current version. Continued use of the Site or Services after changes means you accept the revised Terms.
